Back in July, the Securities and Exchange Commission established new regulations mandating that public companies must reveal cyberincidents with significant consequences through an accessible 8-K filing within four business days. Companies are also obligated to provide additional information regarding their internal cybersecurity programs in their yearly reports.
The rule will come into effect for most companies on Dec. 18. Cybersecurity and legal experts have warned that identifying which breaches are significant enough to require reporting can be challenging, and there has been concern across C-suites about whether increased transparency may get companies in hot water with investors, customers and clients.
For alternative investment firms that are already grappling with other regulatory concerns, the picture is even murkier — and more daunting.
